By accessing or using MoveBoss Pro ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including carriers, owner-operators, dispatchers, drivers, and moving companies.

2. Description of Service

MoveBoss Pro is a trucking and moving company management platform that provides:

  • Load and trip management
  • Driver and fleet tracking
  • Financial management and reporting
  • Compliance monitoring (FMCSA, DOT)
  • Communication tools
  • Partner network and marketplace access
  • Mobile applications for drivers

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing:

  • You agree to pay all fees associated with your chosen plan
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices may change with 30 days notice
  • Refunds are handled on a case-by-case basis
  • We may suspend accounts with overdue payments

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable transportation laws or regulations
  • Transmit false, misleading, or fraudulent information
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to harass, abuse, or harm others
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems to access the Service without permission

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information, including location data from drivers. By using the Service, you consent to such collection and use as described in the Privacy Policy.

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by MoveBoss and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Third-Party Services

The Service may integrate with or contain links to third-party services (e.g., payment processors, mapping services, FMCSA databases). We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOVEBOSS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MoveBoss and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • You remain liable for all amounts due
  • We may delete your account and data in accordance with our data retention policy

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
